Waitangi Tribunal Urgency Hearing

In our last update (December 2018) we let you know that the Waitangi Tribunal had set down an urgent hearing into the Crown’s actions in respect of the Hauraki negotiations, deeds of settlement and overlapping claims process.  The hearing will take place at Waiwhetu Marae, Lower Hutt, next week from 8 April to 12 April (with the powhiri to be held on Sunday 7 April at 3pm).

The six claimants who will be presenting their cases are Ngāi Te Rangi, Te Whakakitenga o Waikato Incorporated and the iwi of Waikato-Tainui, Ngātiwai, Ngāti Manuhiri, Ngāti Porou ki Hauraki and Ngāti Ranginui. 

Te Tāwharau o Ngāti Pūkenga has been granted Interested Party status and can file evidence, can cross examine witnesses and file opening and closing submissions.  Our evidence conveys the key messages we set out in our last update (click here).  To read our Brief of Evidence filed last month in the Tribunal, (click here) (1).   

Our Tauranga kāinga is also participating in the Tribunal proceedings as an interested party.  However, they are limited to filing opening and closing submissions.  The Tauranga kāinga did seek to file evidence, which was supported by Te Tāwharau, but the Tribunal declined their application.

Because there are six claims to hear and only one week to hear them all, the hearing next week will try to save time by not having all witnesses appear.  As well, those who do appear, will not read out their Briefs of Evidence.  Only witnesses whose evidence is disputed by other parties, will appear and be cross examined (asked questions) about their evidence. No one wants to test / dispute our evidence and so we will not need to appear.  Instead, our Brief of Evidence will be accepted as is by the Tribunal. 

To see the hearing timetable click here .  You will see that witnesses from Ngāi Te Rangi will be cross examined on Monday, Ngāti Ranginui on Wednesday, the Crown on Thursday and Friday, and some of the Hauraki iwi (2) , on Friday. 

Te Tāwharau believes it is important that Ngāti Pūkenga are in attendance at the hearing in Wellington, and have supported the attendance of all Kāinga representation.  For those unable to attend in person, the hearing will be livestreamed.  The link will be different each day and will be posted to this page when received.   Day One link is https://youtu.be/apzXrzNT8is

(1) In the Brief of Evidence of Areta Donna Gray, there is reference to evidence to be filed by Rauangi Ohia.  Initially, it was intended that Rauangi would also provide a Brief of Evidence on behalf of Te Tāwharau, about the difference between mana whenua and interests.  However, we were unable to consult with all our kāinga and come to an agreed Ngāti Pūkenga position before we had to file, so only the Brief from Areta was filed.

(2) Not all of the iwi of Hauraki are participating in the Tribunal proceedings.  Those who are include Ngāti Maru, Ngāti Tamatera, Ngaati Whanaunga, Te Patukirikiri and Ngāti Paoa (represented by Paul Majurey) and Ngāti Tara Tokanui (represented by McCaw Lewis).  Ngāti Rahiri Tumutumu is an interested party but has been watching the proceedings rather than participating to date.
